1. Agreement to Terms
By entering into a project statement of work (SOW), commissioning engineering services, or utilizing digital products created by Guessy.in, you agree to be bound by these Terms of Service. If negotiating a tailored enterprise Master Services Agreement (MSA), the terms of that signed agreement shall take precedence.
2. 100% Intellectual Property (IP) Ownership Handover
Guessy.in operates on a strict "Work for Hire" model. Upon final settlement of agreed project milestone invoices:
- Complete Ownership: 100% full legal title, intellectual property, copyrights, and commercial rights for all bespoke source code, database architectures, game art assets, and documentation pass unconditionally to the client.
- Zero Royalty: Guessy.in retains zero ongoing royalty claims, licensing fees, or hidden backend liens on software created for the client.
- Open Source & Third-Party Assets: Any third-party libraries (e.g., Unity engine runtime, Flutter, MIT/Apache 2.0 open-source libraries) remain subject to their respective permissive licenses.
3. Confidentiality & Non-Disclosure (NDA)
Both parties agree that all trade secrets, financial terms, proprietary algorithms, game designs, and user metrics disclosed during discovery, development, or maintenance are confidential. Neither party will disclose proprietary materials without prior written consent.
4. Milestone Deliverables & Acceptance Testing
Fixed-bid projects are executed in clearly defined agile milestones. Upon delivery of a milestone build (via GitHub repository commit, APK, TestFlight build, or staging environment):
- The client has an agreed evaluation period (typically 7 business days) to perform User Acceptance Testing (UAT).
- Any bugs, functional discrepancies, or deviations from the signed Statement of Work are remediated by Guessy.in at zero additional cost prior to final milestone sign-off.
5. 6 Months Free Post-Launch Warranty
Every custom project delivered by Guessy.in includes 6 months of complimentary post-launch warranty support covering:
- Fixing reproducible software bugs and server exceptions resulting from our codebase.
- Minor OS compatibility patches (for new iOS and Android releases).
- Database indexing, initial performance monitoring, and server scaling health checks.
6. Limitation of Liability
In no event shall Guessy.in be liable for indirect, incidental, punitive, or consequential damages (including loss of profits, downtime, or business interruption) arising from store policy rejections beyond our reasonable control or client modifications to production codebases. Total liability is capped at the total amount paid by the client under the applicable Statement of Work.
